1. Acceptance of Terms

By accessing or using Mayo, Ketchup, Mustard ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access or use the Service.

2. Description of Service

Mayo, Ketchup, Mustard is a crowdsourced condiment-recommendation platform for entertainment purposes only. It is not a food-safety or dietary-guidance service.

3. Eligibility and Age Requirement

This Service is intended for individuals aged 13 and older. If you are under 13, please do not use the Service.

4. User Conduct

You agree to:

• Use the Service in a lawful manner
• Not overload, spam, or abuse the Service
• Not submit malicious or automated code
• Not attempt to interfere with, reverse engineer, or disrupt any part of the Service

5. User-Generated Content

5.1 Food Suggestions

When you suggest a new food item or condiment pairing, you:

• Grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, display, and incorporate your suggestion into our database and derivative works
• Retain ownership of your submission, but understand it becomes part of our public database
• Represent that the content is original to you or that you have the right to submit it
• Acknowledge that your submission may be viewed publicly and moderated at our discretion

5.2 Content Moderation

We reserve the right to review, edit, hide, or remove any user-generated content at our sole discretion, including but not limited to content that:

• Violates these Terms
• Contains prohibited or unlawful material
• Is spam, repetitive, or irrelevant
• Degrades the quality or experience of the Service

6. Prohibited Content

You may not submit or post content that:

• Contains hate speech, harassment, bullying, or discrimination
• Is sexually explicit, pornographic, or obscene
• Promotes violence, self-harm, or illegal activity
• Infringes on copyrights, trademarks, or other rights
• Contains personal information about yourself or others
• Is advertising or commercial solicitation
• Contains malware, viruses, or malicious code
• Is false, deceptive, or misleading
• Is unrelated to food or condiments

7. Intellectual Property Rights

The Service, including its software, design, branding, and aggregated data, is owned by Mayo, Ketchup, Mustard and protected by applicable copyright and trademark laws.

Our compiled database of foods and condiment pairings, including all voting data and derived statistics, is our intellectual property. User submissions remain owned by their authors but are licensed to us as described in Section 5.

7.3 Use of Service Name and Branding

You may not use the "Mayo, Ketchup, Mustard" name, logo, or any related trademarks without our prior written consent.

8. Disclaimer and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" FOR ENTERTAINMENT PURPOSES ONLY. WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We are not responsible for any damages arising from the use or inability to use this Service.

Food Safety: Use your own judgment regarding food safety, allergens, or dietary restrictions.

Liability Cap: In no event shall our total liability exceed CAD $10.

9. Indemnification

You agree to indemnify and hold harmless Mayo, Ketchup, Mustard, its officers, employees, and agents from and against any claims, losses, damages, liabilities, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your submission of content

10. Third-Party Services

The Service uses third-party providers for analytics and advertising.

10.1 Google Analytics

We use Google Analytics to analyze anonymous usage trends. Use of this feature is subject to Google's Privacy Policy: https://policies.google.com/privacy

10.2 Google AdSense

We display advertisements through Google AdSense. Ad interactions are subject to Google's Advertising Terms: https://policies.google.com/technologies/ads

We are not responsible for the practices or content of these third-party services or for any data they may collect.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the most current version on this page and update the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the new Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. You may stop using the Service at any time.

13. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Province of Alberta and the federal laws of Canada, without regard to conflict-of-law principles. You agree to submit to the exclusive personal jurisdiction of the courts located in Edmonton, Alberta for any disputes.
